Gary Nickerson has been practicing law for 25 years and has concentrated his practice in the representation and counseling of employers in workers’ compensation and related employment matters. He counsels employers on the day-to-day application of the discrimination and reinstatement provisions of the West Virginia Workers' Compensation Act, the ADA, the FMLA and other laws affecting injured or disabled workers. He also counsels clients on the interaction between workers' compensation and other employee benefits, including health and disability insurance, sick pay, vacation pay, and other benefits. Mr. Nickerson is Managing Member of the firm’s Clarksburg office.

REPRESENTATIVE EXPERIENCE

  • Defended manufacturer in workers’ compensation claim and deliberate intent claim of non-Hodgkins lymphoma allegedly caused by exposure to paint fumes
  • Defended major coal company in a variety of claims of disease allegedly due to chemical exposure, including exposure to solcenic, perchloroethylene and other chemical solvents
  • Defended numerous industries and businesses in claims of occupational pneumoconiosis
  • Defended numerous industries and businesses in claims of occupational hearing loss
  • Defended numerous employers in claims of permanent total disability
  • Defended national manufacturers in aviation and other industries in claims of disease and cancer allegedly related to exposure to chemicals including arsenic, trichloroethylene, trichlorethane, and benzene
  • Defended major energy company in a claim related to exposure to manganese in welding rods and the alleged development of Parkinsons-like symptoms
  • Defended a major newspaper company, a coal company, a casket manufacturer and an oil and gas drilling company in claims involving acute myocardial infarction or sudden cardiac death
  • Defended nursing homes and hospitals in variety of orthopedic claims and claims related to medically related exposures, including staph infections, HPV and shingles
  • Defended manufacture in claim of injury allegedly due to inhalation of PVC (polyvinyl chloride) fumes
  • Defended manufacturers in claims involving asbestos related illness and mesothelioma
  • Defended claim of suicide alleged caused by the psychological effects of an occupational injury
  • Defended occupational stress related claims including cardiac arrhythmia, colitis and other physical and mental conditions
  • Assisted in drafting legislation for major workers’ compensation reform for the State of West Virginia
