Gary Nickerson has been practicing law for 28 years and has concentrated his practice in the representation and counseling of employers in workers’ compensation and related employment matters. He counsels employers on the day-to-day application of the discrimination and reinstatement provisions of the West Virginia Workers' Compensation Act, the ADA, the FMLA and other laws affecting injured or disabled workers. He also counsels clients on the interaction between workers' compensation and other employee benefits, including health and disability insurance, sick pay, vacation pay, and other benefits. Mr. Nickerson is Managing Member of the firm’s Bridgeport office.

REPRESENTATIVE EXPERIENCE

  • Defended manufacturer in workers’ compensation claim and deliberate intent claim of non-Hodgkins lymphoma allegedly caused by exposure to paint fumes
  • Defended major coal company in a variety of claims of disease allegedly due to chemical exposure, including exposure to solcenic, perchloroethylene and other chemical solvents
  • Defended numerous industries and businesses in claims of occupational pneumoconiosis
  • Defended numerous industries and businesses in claims of occupational hearing loss
  • Defended numerous employers in claims of permanent total disability
