REPRESENTATIVE EXPERIENCE

  • Defended client to the Ohio Supreme Court in a major chemical company’s challenge to Ohio EPA’s application of OAC 3745-21-07 (the “8 and 40 rule”) to its container filling operations
  • Defended a major new source review permit issued to a public university against a citizen suit challenge that Ohio EPA did not properly establish Best Available Control Technology (BACT). Had the citizens group been successful, the university would have potentially had to install additional pollution controls, costing millions of dollars.
  • Assisted in first appellate court decision on Ohio EPA’s Title V permitting program
