Ken Barton concentrates his practice to serve the various needs of the business and professional communities of the Eastern Panhandle. He has tried a wide variety of cases in Virginia, West Virginia state courts, District of Columbia and federal district courts, and has argued cases before the West Virginia Supreme Court of Appeals, the Virginia Supreme Court, the District of Columbia Court of Appeals, and the United States Court of Appeals for the Fourth Circuit.  He currently serves as Managing Member of the Martinsburg office.

Commercial Transactions and Commercial Litigation
Representation of major businesses and lending institutions is a significant portion of Ken’s practice. He has:

• Represented both lenders and borrowers in commercial and residential loans
• Advised clients regarding appropriate business entity formation
• Prepared and enforced mechanic’s liens for general contractors
• Negotiated contracts for sales of businesses and business dissolutions
• Represented clients in other commercial litigation matters

Real Estate Development and Settlements 
Representation of real estate developers in all phases of subdivision development is a substantial portion of Ken’s practice. He has:

• Represented clients in land acquisition
• Assisted in securing financing for infrastructure and construction
• Prepared homeowner covenants and restrictions in compliance with state law and local subdivision regulations
• Represented land developers before county planning and zoning commissions
• Successfully prosecuted appeals from planning commission decisions
• Performed real estate settlements

Hospital and Medical Professional Liability and Healthcare Law   
The representation of physicians and hospitals across West Virginia is another portion of Ken’s practice. He has:

• Represented clients in virtually every medical specialty
• Investigated incidents prior to claims being asserted
• Negotiated and tried contested cases
• Advised hospitals regarding the credentialing of physicians
• Negotiated contracts on behalf of hospitals

Ken is a member of the State Bars of Virginia, West Virginia and the District of Columbia. He is on the Board of Directors of the Martinsburg Berkeley County Chamber of Commerce. He has held all chamber offices, including President. He is also a member of the Branch Banking and Trust Company Advisory Board for the Eastern Panhandle of West Virginia, and a member of the Community Advisory Board to City Hospital. He is also a member of the SPARC Foundation Board of Directors. Ken has also held all offices of the Board of Directors of United Way of Berkeley and Morgan Counties, including President. Ken serves on the Steering Committees of the Gateway Foundation Golf Tournament.  Ken is recognized in The Best Lawyers in America in the field of real estate law.

Ken received his law degree from the University of Notre Dame and his undergraduate degree from the Philadelphia College of Pharmacy and Science with a B.S. degree in Pharmacy.
