Todd Swanson focuses his practice primarily on public and private utility law. Mr. Swanson represents privately-owned public utilities, both publicly traded and closely held, as well as public-owned public utilities such as municipalities and public service districts, and motor carriers of passengers and property. He has experience litigating applications for certificates of public convenience and necessity, utility rate base rate cases, affiliated transaction cases, cost of gas purchased cases, purchases and sales of public utilities, and defense of customer complaint cases before the Public Service Commission of West Virginia.

REPRESENTATIVE EXPERIENCE

  • Represented a major utility company in a variety of matters before the Public Service Commission of West Virginia, including the prosecution of base rate cases, cost of gas purchased cases, and formal customer complaint cases
  • Represented a natural gas gathering company before the Public Service Commission of West Virginia in a dispute involving an assertion by a natural gas producer that the company’s gathering system was subject to regulation as an intrastate pipeline
  • Represented municipality in the sale of its water and sewer systems
