Why should you worry about wage and hour compliance and Department of Labor Audits? Errors in compliance with state wage and hour laws and the Fair Labor Standards Act are frequent and the cost of fines and penalties are staggering.
As a result of the expansion of shale gas activities in the region and the increasing number of oil and gas jobs, the Department of Labor (“DOL”) has increased its enforcement efforts under the federal Fair Labor Standards Act (“FLSA”) in Pennsylvania, Ohio and West Virginia. The DOL believes that up to 80% of employers are not in compliance with the FLSA and the Wage and Hour Division has announced a multiyear enforcement initiative focused on oil and gas companies and related businesses such as tree clearing, quarries, road construction, paving, masonry, and water and stone hauling.
