New Business Court Division Aims to Better Resolve Business Disputes

West Virginia has a new circuit court division for resolving business disputes. The Supreme Court of Appeals of West Virginia established a Business Court Division in West Virginia's circuit courts to more efficiently and effectively manage business litigation. The newly created Court will be based in Martinsburg, WV.

The addition of the Business Court Division here allows clients across the state and region to more efficiently handle business litigation matters, and our Martinsburg office is conveniently located to provide both legal services in the Business Court Division and to host alternative dispute resolution for non-clients."

Beginning October 10, the Business Court Division will be available for disputes between businesses that are originally filed in a circuit court.  The Court will handle litigation over business transactions, operations and governance.  Complex business tax appeals also may be moved to the Division, although other administrative disputes are excluded from its jurisdiction.  Also excluded from the Division's jurisdiction is consumer litigation, such as products liability, personal injury, wrongful death, and consumer credit actions.
