Steptoe & Johnson's Long Term Care Team includes attorneys, legal assistants, and nurses from the firm's litigation, business, and labor groups, offices located throughout West Virginia, Ohio, Kentucky and Pennsylvania. Group lawyers offer services in general litigation defense, both standard of care and general negligence; labor and employment representation, including wrongful termination, counseling, and workers' compensation; and regulatory compliance, including assistance with development of plans of correction. The group represents numerous national long term care providers in this litigation-intensive health care field.

Representative Experience

  • Assisted in the sale of assets of a substantial independent and assisted living facility and related nursing home, and that necessitated the defeasance of publicly held tax-exempt indebtedness
  • Represented a national nursing home chain at trial in a wrongful death action involving death of resident from urosepsis. Punitive damages sought for alleged understaffing, false documentation and other issues.
  • Trial counsel to national nursing home chain in contested proceeding to obtain administrative approval of sale of private equity; favorable decision helped allow transaction to close
  • Defended multiple long term care facilities in claims involving medical negligence (including wound development, infection, falls, understaffing and malnutrition) and punitive conduct
  • Represented a national nursing home chain at trial in a wrongful death action involving a 38-year old individual suffering from multiple sclerosis. Punitive damages were sought based on alleged understaffing and other issues.
