Energy Law Update: EPA Greenhouse Gas Rule to Become Effective December 29, 2009

The Environmental Protection Agency (EPA) has issued its final rule regarding the mandatory reporting of greenhouse gas emissions, which will become effective on December 29, 2009. The new rule requires the reporting and monitoring of greenhouse gas emissions by all sectors of the economy, including fossil fuel suppliers and industrial gas suppliers, direct greenhouse gas emitters, and manufacturers of heavy-duty and off-road vehicles and engines where annual greenhouse gas emissions exceed the stated thresholds (in most cases, 25,000 metric tons of CO2 equivalents). While the new rule requires the monitoring and reporting of greenhouse gas emissions, it does not require companies to control or otherwise regulate such emissions.
