Alert: Federal Court Rules Extension Payment to Old Lessor Extends Lease
In Danko Holdings, L.P. v. Exco Res. Pa., No. 4:14-CV-274, 2014 U.S. Dist. LEXIS 137104 (M.D. Pa. Sept. 29, 2014), the Federal District Court for the Middle District of Pennsylvania ruled against a lessor who claimed that a payment to extend a lease’s primary term was not properly paid and that the lease had terminated. The extension payment had been tendered to the original lessor, who had sold the property, unbeknownst to the lessee. The lease contained a “change of ownership” provision requiring that lessor notify lessee of any change in ownership of the leased property.
Alert: Amendments to PA Law Enhance the Ability to Rely on Powers of Attorney
The Pennsylvania General Assembly passed House Bill 1429 amending Pennsylvania’s law on powers of attorney (20 Pa.C.S. §§ 5601-5612), which was signed into law by Governor Tom Corbett on July 2, 2014 as Act 95 of 2014.  The provisions of Act 95 are of particular importance to third parties within the energy industry who regularly rely on powers of attorney (“POA”) to engage in financial and property transactions.  The provisions discussed below apply to POAs created before, on, or after July 2, 2014, but do not apply to the acts or omissions of agents, or third parties presented with instructions by agents, that occurred prior to July 2, 2014. Alert: Ohio Court Favors Surface Owner in Dormant Mineral Act Ruling
Walker v. Noon was recently decided by the Ohio Seventh District Court of Appeals. Walker is noteworthy because it is the first appellate level decision addressing the automatic reversion provision under the 1989 version of the Ohio Dormant Mineral Act (ODMA).
