Carl A. Misitano

Of Counsel

Carl Misitano brings extensive experience in labor and employment law, including representing a major client in the railroad industry where he managed employment litigation cases across 20 of the 22 states in which the company operated. Carl has served as lead counsel in mediations involving employment discrimination claims in front of private mediators and federal magistrate judges. Additionally, he has successfully argued motions before state and federal courts in Pennsylvania and Massachusetts.

In addition to his labor and employment work, Carl has considerable litigation experience and has conducted countless depositions and drafted multiple motions for summary judgment. His diverse caseload involves regular client engagement, witness preparation, motion practice, and discovery management, including drafting and responding to requests.

Prior to law school, Carl served nine years as a Surface Warfare Officer in the U.S. Navy where he focused on naval engineering and small craft combat operations.

Representative Experience

  • Represented a fuel supply company in bench trial involving a contract dispute against a retailer
  • Drafted successful Third Circuit appellee brief resulting in the affirmation of the lower court’s grant of summary judgment in client’s favor
  • Represented 15 disabled student plaintiffs in complex personal injury and civil rights claim against a public school district in a three-day mediation resulting in a $950,000 settlement
  • Represented 17 disabled student plaintiffs in complex personal injury and civil rights claim against a private school residential program during a three-day mediation resulting in a seven-figure settlement
