Biography

Kristen Andrews Wilson’s practice is an intersection of regulatory compliance and litigation defense. Kristen’s clients include hospitals, nursing homes, long-term care facilities, hospice, and home health, as well as independent general practice and specialty physicians. Within her litigation practice, Kristen’s goal is helping clients avoid costly and disruptive litigation by advising them on best practices and easily implementable solutions. Kristen’s litigation practice goes hand in hand with the regulatory guidance that she provides clients across several states.

Representative Experience

  • Provided federal regulatory guidance for multi-state health care entity in sale of assets in multiple jurisdictions
  • Represented employed and independent physicians and nurses before various West Virginia and Pennsylvania licensure boards, including the West Virginia Osteopathic Medicine Board, the West Virginia Board of Medicine, the Pennsylvania State Board of Medicine, and the West Virginia RN Board
  • Served as regulatory counsel for healthcare entities on Stark Law, the Anti-Kickback Statute, HIPAA, the HITECH Act, and the corporate practice of medicine doctrine
  • Won jury verdict on behalf of physician in a medical malpractice case involving permanent injuries and death
  • Advised healthcare clients on Certificate of Need (CON) matters in West Virginia, for acquisitions and divestitures, addition of services, and opposition of duplicative services
  • Defended long-term care facilities against claims for alleged violations of state nursing home acts and medical negligence
  • Prepared Certificate of Need for the reopening of an adolescent in-patient mental health facility
  • Advised multi-faceted health insurance company on regulatory compliance
  • Defended physicians in medical negligence lawsuits
  • Represented health care entities in a variety of transactions, including leasing, employment, and independent contractor arrangements
  • Acted as local defense counsel for False Claims Act lawsuit brought on behalf of whistleblower
  • Drafted informed consent authorizations for hospital
  • Represented numerous long term care facilities and assisted living facilities in numerous wrongful death actions brought by families of deceased former residents
  • Advising health insurance company in prompt pay litigation
  • Advised clients during and after surveys, including mitigation of immediate jeopardy, responding to statements of deficiency, and challenging citations, Civil Monetary Penalties, and other enforcement activity
  • Defended long term care facilities in COVID 19 litigation in State, Federal District Court, and Appellate Courts involving claims of immunity under the PREP ACT
