Vincent Holzhall

Biography

Vince Holzhall spends his time solving problems for his clients. Clients appreciate Vince’s ability to provide solutions, usually involving unique areas of the law. Vince is often sought by clients wishing to avoid costly and lengthy lawsuits, but he is no stranger to contentious litigation. He puts his skills to use representing banks, institutions of higher education, energy companies, and others. Recently, Vince used his litigation and management skills to assist a private liberal arts college to enforce a pledge agreement and assist a multidistrict litigation client to transfer over 100 Ohio matters into the MDL. Vince’s calming nature is a benefit to clients as he guides them through complex litigation matters, as well as administrative processes.

Representative Experience

  • Litigated claims involving payment systems, commercial paper, electronic payments, and wire transfers under the Uniform Commercial Code (the “UCC”) and federal regulations
  • Representing creditors in bankruptcy and foreclosure proceedings
  • Represented private liberal arts college in a matter involving challenges to the philanthropic wishes of a deceased donor and the enforceability of a signed pledge agreement
  • Managed high-stakes pharmaceutical, multidistrict litigation for over 100 matters in Ohio
  • Prepares unitization applications for submission to the Ohio Department of Natural Resources on behalf of operators
  • Mitigated risk for publicly-traded energy companies involving challenging landowner issues
  • Representing banks relating to personal identifiers, financial privacy, Bank Secrecy Act, and fiduciary issues
  • Solving issues for energy companies regarding pipeline and well construction, master service agreements, easements, eminent domain, and water runoff issues
  • Defending banks against claims brought under the Electronic Fund Transfer Act, the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the Equal Credit Opportunity Act
  • Represented banks and business entities in over 20 appellate proceedings
  • Resolved claims involving corporate fraud and embezzling employees
