Biography

David Morrison focuses his practice in the area of labor and employment and has over 30 years of experience in employment counseling, including supervisory training. He has tried over 80 cases and arbitrations, and has argued over 20 appeals before state and federal appeals courts.

Representative Experience

  • Sought to set aside three arbitration awards in the natural gas industry
  • Provided diversity training at both coal mines and compressor stations in West Virginia, Virginia, Maryland and Kentucky
  • Defended retaliatory discharge and discrimination claims in health care, chemical, auto sales, aluminum products, retail, wood products, legal, high tech, education, banking, natural gas, coal, pharmaceutical and other industries
  • Provide day-to-day advice on employment issues from hiring to firing
  • Provided advice and assistance in eight workforce reductions for a large coal company
  • Provided advice and assistance in five workforce reductions in the natural gas industry
  • Provide day-to-day advice on employment issues for surface and underground coal companies, ranging from hiring procedures to internal investigations to issuing discipline
  • Provide day-to-day advice on employment issues to natural gas drilling and transmission companies on all sorts of issues, ranging from drug testing to disability determinations and accommodations to issuing discipline
  • Sought summary judgment in four cases where the federal district court was asked to overturn labor arbitration awards
  • Handled over 100 employment-related lawsuits in the coal industry and over 40 in the natural gas industry
  • Tried to a jury verdict 18 cases in the coal industry and six in the natural gas industry, with most cases being disposed of through summary judgment or settlement
  • Obtained more than 25 injunctions for illegal strike misconduct
  • Handled over 10 arbitrations in the natural gas industry
  • Investigated numerous instances of workforce misconduct by employees in the coal and oil and gas industries
  • Sought summary judgment for a large truck stop chain in federal district court in which the plaintiff claimed fraud in the inducement
  • Jury trial for a large chemical manufacturing company in a case brought by seven women alleging sex discrimination
  • Assisted large West Virginia bank in post-merger reorganization of its workforce
  • Jury trial for a large chemical manufacturing company in a case brought by seven women alleging sex discrimination
  • Sought summary judgment for a large truck stop chain in federal district court in which the plaintiff claimed fraud in the inducement
  • Handled arbitrations against the Teamsters, Steel Workers, Brick Layers, Service Employees, and Chemical Workers unions
  • Handled union elections in wood products, aluminum products, chemical, retail, health care, natural gas, coal and hospitality industries
  • Defended discrimination claims of race, gender, age, disability, religion and national origin in state and federal court, as well as claims brought before the EEOC and state human rights agencies in West Virginia, Kentucky, Pennsylvania, Louisiana, Tennessee, New York, Florida and South Carolina
  • Obtained state and federal court injunctions for illegal strike activity in the chemical, tire manufacturing, coal, natural gas, trucking, wood products and aluminum products industries
  • Handled a number of FLSA / Wage and Hour issues for clients both in litigation and in the investigative stage by the Department of Labor
  • Argued over 20 cases to the West Virginia State Supreme Court of Appeals, the United States Court of Appeals for the Fourth Circuit and the New York Court of Appeals
  • Tried over 30 wrongful discharge cases in state and federal courts throughout the region
  • Provided many training sessions to employees of clients on various HR topics, including EEO matters, harassment, documentation, investigations, hiring and interviewing, and factors to consider before firing
