Clay Davis

Biography

Clay Davis handles high-stakes civil litigation and trials with urgency. When threatened by emergent crises, claims of catastrophic injuries under aggravating circumstances, technical complexity, and sensitive publicity, sophisticated clients trust Clay for steady guidance through – or around – trial and appellate courts or arbitration to an efficient and creative resolution. Clay also advises on how to prospectively mitigate such risks.

Representative Experience

  • Wrote the no-duty summary judgment argument (in an ensemble motion) excusing a Grammy-winning rapper from ten-fatality concert “crowd crush” multi-district litigation
  • Represented a Country Music Association Award-winning singer suddenly unable to sing after oral surgery exceeded informed consent
  • Obtained permanent injunctions stopping misappropriation of a plastics manufacturer’s trade secrets, and meanwhile negotiated an advantageous triangular sale of its distressed inventory to intervening competitors
  • Maintained consistent defenses across dozens of injury lawsuits for every domestic operating subsidiary of an omnipresent parcel delivery logistics conglomerate, as well as for the disparate independent service providers sharing their motor carrier operating authority
  • Parachuted in after an adverse dangerous-dogs finding, won an absolute defense judgment by delicately cross examining the nine-year-old alleged victim of two German Shepherds to expose her parents’ conspiracy to exaggerate her story
